Incapacitation in the context of sentencing theory refers to the effect of a sentence in terms of positively preventing (rather than merely deterring) future crimes. 18 U.S.C. ยง 3553(a)(2)(C) states that the sentence imposed should "protect the public from further crimes of the defendant".
